Terms of Service

1. Introductory Provisions

These Terms of Service (hereinafter "Terms") govern the relationship between the entrepreneur Nichita Roilean, Company ID: 22389032, with registered office at Petrzilkova 2705/32, 158 00 Prague, Czech Republic (hereinafter "Provider") and the customer (hereinafter "Customer") when using the Sitely service.

Sitely is an online platform for automated website creation using artificial intelligence, aimed at entrepreneurs and businesses.

2. Definitions

• Service: The Sitely platform and all its features including AI website generation, hosting and domain management
• User Account: Customer's personal space on the Sitely platform
• Website: A web presentation generated using AI on the Sitely platform
• Subscription: Regular payment for the use of premium service features

3. Registration and User Account

3.1 Account Creation

• Registration and creation of a user account is required to use the service
• The Customer is obliged to provide truthful and current information during registration
• The Customer is responsible for maintaining the confidentiality of login credentials
• One account may only be used by one person or company

3.2 Age Restriction

The service may only be used by persons over 18 years of age or with written consent of a legal guardian.

3.3 Account Deletion

The Customer may delete their account at any time in settings. The Provider reserves the right to delete an account in case of violation of these Terms.

4. Services and Features

4.1 Basic Services

• AI generation of websites based on business information
• Management and editing of created websites
• Website hosting on the preview.sitely.cz domain
• Basic traffic analytics

4.2 Premium Features

• Custom domain connection
• Advanced analytics (Google Search Console integration)
• Extended add-ons (blog, multilingual, contact forms)
• Removal of "Powered by Sitely" link

4.3 Service Limitations

The service includes the following limits, which may change according to the current offer:

• AI content generation: Basic monthly quota of 5 AI blog posts per website. Additional credits can be purchased after exhaustion (see section 5.4).
• Traffic: Basic plan includes 5,000 unique visitors per month per website. Customer will be notified at 80% usage. At 100%, customer will be contacted for an individual solution.
• Website content: Maximum 500 blog posts per website, 20 collections per website, 500 items per collection and 50 builds per day.
• Storage and files: The Provider reserves the right to limit storage size, number of uploaded files and their maximum size.

The Provider reserves the right to unilaterally adjust these limits. Customers will be informed of changes via email or in-app notifications.

4.4 AI Feature Availability

AI content generation depends on third-party services (Anthropic Claude). The Provider does not guarantee uninterrupted availability of AI features and is not responsible for outages caused by third parties. In case of AI service unavailability, the Customer is not entitled to compensation for unused AI credits.

5. Payment Terms

5.1 Prices and Plans

• Current pricing is available on the /pricing page
• Prices are listed in Czech crowns (CZK) including VAT
• The Provider reserves the right to change prices with 30 days' prior notice

5.2 Payment Methods

Payments are processed through the Stripe payment gateway. Supported payment methods include credit cards and other methods as available.

5.3 Subscription

• Subscriptions are automatically renewed at the end of the chosen period
• The Customer may cancel the subscription at any time in account settings
• After cancellation, the subscription remains active until the end of the paid period
• No refund is provided for cancelled subscriptions

5.4 AI Credit Packages

• AI credits are used to extend the monthly AI-generated content quota (blog posts)
• These are one-time payments processed through Stripe
• Purchased credits are non-refundable and cannot be exchanged
• Credits are tied to a specific website and cannot be transferred between websites
• Purchased credits have no expiration date
• Current credit package prices are shown in the application interface

6. Content Rights

6.1 Customer Content

• The Customer retains all rights to content uploaded to the platform
• The Customer grants the Provider a license to display, store and process content for the purpose of providing the service
• The Customer represents that they have rights to all content they upload

6.2 AI-Generated Content

Content generated by artificial intelligence is the property of the Customer. The Provider notes the following limitations:

• AI content may not be unique -- similar content may be generated for other users
• AI content may contain factual inaccuracies -- the Customer is responsible for verification
• The Provider does not guarantee SEO performance, quality or suitability of AI-generated content for specific purposes
• The Customer bears full responsibility for content published on their website, including AI-generated content
• The Provider recommends reviewing and editing AI content before publication

6.3 Prohibited Content

It is prohibited to upload content that:

• Infringes third-party copyrights
• Is illegal, defamatory, discriminatory or obscene
• Contains malware, viruses or other harmful code
• Promotes violence, terrorism or extremism

7. Liability and Warranties

7.1 Service Availability

The Provider commits to maintaining the service available at least 99% of the time monthly. Scheduled maintenance will be announced in advance.

7.2 Limitation of Liability

• The service is provided "as is" without any warranties
• The Provider is not liable for damages caused by service unavailability
• The Provider is not liable for content created or uploaded by the Customer
• Maximum compensation is limited to fees paid by the Customer in the last 3 months

7.3 Data Backup

The Provider performs regular backups, but recommends Customers maintain their own backups of important data.

8. Fair Use Policy

The Customer agrees to use the service reasonably and in accordance with its purpose. The Provider reserves the right to limit or suspend access to the service in case of:

• Automated or bulk content generation beyond normal usage
• Misuse of AI features for purposes unrelated to Customer's website operation
• Repeated exceeding of traffic limits without addressing the situation
• Using the service in a way that negatively affects platform performance for other users
• Creating content for the purpose of search engine manipulation (SEO spam)

The limits specified in section 4.3 are set at a level that allows normal use of the service. If higher limits are needed, the Customer can contact support for an individual solution.

9. Personal Data Protection

Processing of personal data is governed by our Privacy Policy and is in compliance with GDPR.

10. Changes to Terms

The Provider reserves the right to change these Terms. Customers will be informed of material changes via email at least 30 days before the changes take effect. By continuing to use the service after the changes take effect, the Customer agrees to the new Terms.

11. Dispute Resolution

11.1 Out-of-Court Resolution

In case of a dispute, the parties commit to first seek an out-of-court resolution.

11.2 Governing Law

These Terms are governed by the laws of the Czech Republic.

11.3 Jurisdiction

Courts of the Czech Republic have jurisdiction over any disputes.

13. Final Provisions

These Terms of Service take effect on February 28, 2026. If any provision of these Terms becomes invalid or unenforceable, the remaining provisions shall remain in full force and effect.
